Acceptance of Terms
These Terms form a binding agreement between you and VahanConnect, an operator based at Phase 8B, Industrial Area, Sector 74, Sahibzada Ajit Singh Nagar, Punjab 160071, India ("we", "us"). By creating an account, purchasing a device, or installing the mobile app, you confirm that you have read, understood and accept these Terms together with our Privacy Policy.
If you are using the Services on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.
Eligibility
You must be at least 18 years old to register and use the Services.
You must own the vehicle being tracked, or have written authorisation from the owner / employer / fleet operator to track it.
You must comply with all applicable Indian laws including the Motor Vehicles Act, the Information Technology Act, the Digital Personal Data Protection Act and any local laws on vehicle tracking and driver monitoring.
Permitted Use
The Services are intended exclusively for fleet management, transport operations, vehicle security and lawful asset monitoring. Examples include: tracking your own vehicles, monitoring commercial fleets you operate, recovering stolen vehicles, ensuring driver safety, and meeting regulatory reporting requirements for commercial transport.
Prohibited Uses
You agree not to use the Services for any of the following. Violation will result in immediate suspension and possible legal action:
Covert tracking of individuals — installing a tracker on a vehicle owned by another person without their knowledge and consent.
Stalking or harassment — using location data to follow, intimidate or threaten any person.
Tracking of children without the consent of a parent or legal guardian.
Surveillance of employees beyond what their employment contract authorises and what local labour law permits.
Spousal or partner monitoring without explicit, informed consent.
Reverse engineering, decompiling or attempting to access source code of our hardware or software.
Reselling, sublicensing or repackaging the Services without a written commercial agreement with us.
Any use that violates Indian law or any other law that applies to you.
We cooperate with law enforcement when presented with valid legal process. If you suspect VahanConnect is being misused to track you, contact us at support@vahanconnect.com and we will investigate.
Account Responsibilities
You are responsible for keeping your account credentials confidential. You agree to:
Provide accurate information when registering and keep it up to date.
Use a strong, unique password and enable biometric login on the mobile app where supported.
Notify us immediately at support@vahanconnect.com if you suspect unauthorised access.
Accept that you are responsible for all activity carried out under your account.
Pricing, Subscription & Refunds
Hardware devices are sold under a one-time purchase with optional annual subscription for cloud tracking. GST is charged extra over the listed device price as per applicable Indian rates.
Hardware refund: unused devices in original packaging may be returned within 7 days of delivery for a refund minus shipping. Defective devices are replaced under warranty.
Warranty: 12 months on the GPS device against manufacturing defects, subject to professional installation.
Subscription: annual cloud subscription is non-refundable once activated, except where required by law. You may cancel renewals at any time before the next billing date.
App: the mobile applications are provided free of charge to active subscribers.
Service Availability
We aim for high availability but cannot guarantee 100% uptime. Tracking accuracy and continuity depend on:
- GPS satellite visibility — buildings, tunnels and dense canopies degrade accuracy.
- GSM / mobile network coverage at the device's location.
- Adequate vehicle battery and correct hardware installation.
- Up-to-date device subscription with the SIM provider.
We may schedule maintenance windows, with reasonable notice where possible. Emergency security patches may be applied without advance notice.
Mobile Application Terms
If you install our iOS or Android application:
You are granted a non-exclusive, non-transferable, revocable licence to use the app on your personal devices for the duration of your subscription.
You agree to Apple's App Store Terms (for iOS) or Google's Play Store Terms (for Android) where they apply.
You agree to keep the app updated to the latest version we publish so security fixes are received in a timely manner.
The app uses background location and push notifications only as described in our Privacy Policy.
Termination & Account Deletion
You may request deletion of your account at any time via our account deletion page or by emailing support@vahanconnect.com. We will delete your personal data within 30 days, except where retention is required by law (e.g. GST invoice records).
We may suspend or terminate your account if you breach these Terms, fail to pay subscription dues, or use the Services for prohibited purposes. Where reasonable, we give 30 days' notice before termination.
Intellectual Property
All software, designs, content and trademarks on the website, dashboard and apps belong to VahanConnect or our licensors. You may not copy, modify, distribute or create derivative works without written permission. The hardware you purchase remains yours; the firmware on it is licensed, not sold.
Limitation of Liability
The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law:
- We are not liable for indirect, incidental, special or consequential damages.
- We are not liable for loss caused by GPS / GSM unavailability, satellite drift, vehicle damage, theft, business interruption or third-party actions outside our control.
- Our total liability for any claim shall not exceed the fees you paid to us in the 12 months preceding the claim.
Nothing in these Terms limits our liability where Indian law prohibits such limitation, including for death, personal injury caused by negligence, or fraud.
Indemnity
You agree to indemnify and hold VahanConnect harmless from any third-party claim arising out of (a) your use of the Services in violation of these Terms, (b) your unlawful tracking of any person, or (c) your breach of any applicable law.
Governing Law & Disputes
These Terms are governed by the laws of India. Any dispute will first be attempted to be resolved amicably; failing that, the courts at Mohali / SAS Nagar, Punjab shall have exclusive jurisdiction.
Changes to These Terms
We may revise these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date and, where appropriate, sent to your registered email. Continued use of the Services after a change means you accept the revised Terms.
